General Terms and Conditions (GTC) for the rental of holiday accommodation at living TIMELESS

1. Scope
These General Terms and Conditions (GTC) apply to all contracts concluded with living TIMELESS (hereinafter referred to as the "Landlord") for the rental of holiday accommodations. Deviating agreements require written form.
2. Conclusion of the Contract
2.1 The rental agreement is concluded upon the landlord's written confirmation of the booking.
2.2 Bookings can be made by phone, email, via the website, or through booking platforms.
2.3 By making a booking, the guest acknowledges and accepts these General Terms and Conditions.
3. Payment Terms
3.1 The guest is obligated to pay the agreed rental price on time. Unless otherwise agreed:

A deposit of 50% of the total amount is due within 14 days of the booking confirmation.

The remaining balance must be paid no later than 14 days before arrival.
3.2 For short-notice bookings (less than 14 days before arrival), the full amount is due immediately. Proof of payment must be provided. Check-in may be denied if full payment has not been received.
3.3 Payment can be made via bank transfer, credit card, or the offered payment services.
3.4 Cash payments at the accommodation are not accepted.
4. Arrival and Departure
4.1 The holiday accommodation is available from 4:00 PM on the day of arrival. Early check-in is possible only by prior arrangement and subject to availability, at a charge of €10 per hour.
4.2 On the day of departure, the holiday accommodation must be vacated by 10:00 AM. Late check-out is possible for an additional charge of €10 per hour and must be arranged in advance.
4.3 Access to the holiday accommodation is provided via a key safe. The code will be communicated prior to arrival.
5. Cancellation by the Guest
5.1 Cancellations must be made in writing.
5.2 The following cancellation terms apply:

Up to 14 days before arrival: Free cancellation.

14 to 7 days before arrival: 25% of the rental price.

Less than 7 days before arrival or in case of no-show: 50% of the rental price.
5.3 The guest reserves the right to prove that no damage or significantly lower damage has occurred.
6. Cancellation by the Landlord
6.1 The landlord is entitled to withdraw from the contract for significant reasons, particularly in the following cases:

Force majeure or other unforeseen events that make it impossible to provide the service.

Non-payment by the guest within the agreed timeframe.
6.2 In such cases, any payments already made by the guest will be refunded promptly.
7. Use of the Holiday Accommodation
7.1 The holiday accommodation may only be used by the agreed number of persons.
7.2 Pets are allowed only with prior approval and only in accommodations designated for this purpose.
7.3 The guest agrees to handle the holiday accommodation with care and to use all items properly.
7.4 Any damages occurring during the stay must be reported to the landlord immediately and reimbursed by the guest.
8. Use of the Holiday Accommodation
8.1 The holiday accommodation may only be used by the agreed number of people.
8.2 Deposit Handling
The deposit is not collected or authorized in advance but serves as a contractually agreed security deposit. The guest agrees to pay the agreed amount in full or in part within 14 days of being requested to do so, provided damage is proven.
8.3 Damage Cases
If any damage to the holiday accommodation or its inventory occurs during the stay, the guest will be informed in writing. A detailed damage report (including photos and a cost estimate or invoice) will be provided.
8.4 Contractual Obligation
By completing the booking, the guest agrees to pay the agreed deposit of up to €500 in the event of damage. This obligation is legally binding.
8.5 Miscellaneous
If no damages or exceptional cleaning requirements are identified, no further costs will be incurred by the guest under the deposit agreement.
In the event of disputes regarding the amount of damage, German law applies.
9. Liability
9.1 The landlord is only liable for intentional or grossly negligent breaches of duty.
9.2 The guest is liable for all damages caused by themselves, their fellow travelers, or their visitors.
9.3 The landlord assumes no liability for the guest’s personal belongings brought into the accommodation.
9.4 The landlord reserves the right to request valid identification documents from the guests.
10. Cleaning
10.1 The final cleaning, including laundry, is included in the rental price.
10.2 The holiday accommodation must be left broom-clean on the day of departure. Dishes must be washed, and waste properly disposed of.
11. Miscellaneous
11.1 All utility costs (electricity, water, heating) are included in the rental price unless otherwise stated.
11.2 German law applies.
11.3 Should individual provisions of these General Terms and Conditions be invalid, the remaining provisions shall remain unaffected.
