General Terms and Conditions (GTC) for the rental of holiday accommodation at living TIMELESS

1. Scope
These General Terms and Conditions (GTC) apply to all contracts for the rental of holiday accommodations concluded between living TIMELESS (hereinafter “Landlord”) and the guest.
Deviating agreements require text form.
2. Conclusion of the Contract
2.1 The rental agreement is concluded upon the Landlord’s written booking confirmation.
2.2 Bookings can be made by phone, by email, via the website, or through external booking platforms.
2.3 By making a booking, the guest acknowledges these GTC as binding.
3. Payment Terms
3.1 Unless otherwise agreed, the total amount is due within 14 days after booking confirmation.
3.2 For short-notice bookings (less than 14 days before arrival), the full amount is due immediately.
The Landlord is entitled to refuse check-in if payment is outstanding.
3.3 Payment can be made by bank transfer, credit card, or via available payment services.
3.4 Cash payment at the accommodation is excluded.
4. Arrival and Departure
4.1 The holiday accommodation is available from 4:00 p.m. on the day of arrival.
An earlier check-in is possible by prior arrangement and subject to availability, for an additional fee.
4.2 On the day of departure, the accommodation must be vacated no later than 10:00 a.m.
A later check-out is possible by arrangement and for an additional fee.
4.3 Access to the accommodation is generally provided via a key safe. The access code will be communicated in good time prior to arrival.
5. Withdrawal / Cancellation by the Guest
5.1 Cancellations must be made in text form (e.g. by email).
5.2 A distinction is made between bookings via external booking platforms and direct bookings.
a) Bookings via external booking platforms
For bookings via platforms such as Booking.com, Airbnb or comparable providers, only the respective cancellation conditions stated there shall apply.
b) Direct bookings
In the case of direct bookings, the guest can choose between the following rates. In each case, the rate selected at the time of booking is decisive:
Flex rate (7 days):
Up to 7 days before arrival: free cancellation
Less than 7 days before arrival: 90% of the total price
Flex rate (3 days):
Up to 3 days before arrival: free cancellation
Less than 3 days before arrival or in case of no-show: 100% of the total price
Non-cancellable rate:
Cancellation or changes are excluded.
100% of the total price is due from the time of booking, even in case of no-show.
The time of receipt of the cancellation is decisive for calculating the deadline.
5.3 The guest reserves the right to prove that no damage or a significantly lower damage has occurred.
6. Withdrawal / Cancellation by the Landlord
6.1 The Landlord is entitled to withdraw from the contract for good cause, in particular in the event of:
force majeure or unforeseeable events
non-timely payment by the guest
6.2 In such cases, any payments already made will be refunded without undue delay.
7. Deposit and Damage Settlement
7.1 A deposit of €500 is agreed for the stay as security for damages or extraordinary soiling.
7.2 The deposit is not collected in advance, but constitutes a contractual security deposit.
7.3 In the event of damage, the guest undertakes to pay the confirmed damage within 14 days after being requested to do so.
7.4 Damages must be reported to the Landlord without delay.
Damage documentation (e.g., photos, quotations, or invoices) will be provided.
7.5 If no damages or extraordinary soiling are identified, the guest will not incur any additional costs.
8. Use of the Holiday Accommodation
8.1 The accommodation may only be used by the agreed number of persons.
8.2 Pets are only permitted by prior arrangement and only in accommodations designated for this purpose.
8.3 The guest undertakes to treat the accommodation and its inventory with care.
9. Liability
9.1 The Landlord is liable only for intentional or grossly negligent breaches of duty.
9.2 The guest is liable for damages caused by themselves, fellow travelers, or visitors.
9.3 No liability is assumed for the guest’s personal property brought onto the premises.
9.4 The Landlord is entitled to request the presentation of valid identification documents.
10. Cleaning
10.1 Final cleaning including laundry is included in the rental price unless otherwise agreed.
10.2 The accommodation must be handed over broom-clean on the day of departure.
Dishes must be washed and waste disposed of properly.
11. Miscellaneous
11.1 Utilities such as electricity, water, and heating are included in the rental price unless otherwise agreed.
11.2 German law shall apply.
11.3 Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
